EUROPCAR RENT AND WIN THE ULTIMATE FAMILY ADVENTURE TO NEW YORK (“PROMOTION”) TERMS & CONDITIONS

1. 

Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

2. 

This competition is a game of chance. Skill plays no part in determining the winner.

3. 

Entry is open to all residents of Australia aged 18 years or over. 

4. 

Employees and their immediate families of CLA Trading Pty Ltd (trading as Europcar Australia) (“The Promoter”), Virgin Australia Airlines Pty Ltd (Virgin Australia) and Universal Pictures International Australia Pty Ltd (Universal Pictures) (“The Sponsors”), Engage Australia Digital Pty Limited, and their associated agencies and companies are not eligible to enter.

5. 

The competition commences on Monday 20 May 2019 at 09:00 (AEST) and concludes on Sunday 30 June 2019 at 23:59 (AEST) (“Promotional Period”).

6. 

Subject to clauses 8 to 11 to enter the Promotion, entrants must:

a. Book an eligible rental vehicle in Australia or New Zealand with Europcar via www.virginaustralia.com the Europcar microsite https://partner.europcar.com/virginaustralia/en/home/ the Europcar webpage www.europcar.com.au/newyork or the Virgin Australia co-branded partner website between 09.00 AEST Monday 20 May 2019 and 23.59 AEST Sunday 30 June 2019.

b. The entrant must be the named driver on the rental agreement.

c. Valid for bookings that include rental pickups between Monday 20 May 2019 and Saturday 30 November 2019 (“Travel Period”).

- If the booking is cancelled or refunded at any time during the Travel Period then the entry will be deemed invalid.

d. Limited to one (1) entry per booking/rental agreement number.

 

7. 

Automatic entry to the Promotion will be granted to any customers who make a Europcar car booking via www.virginaustralia.com the Europcar microsite https://partner.europcar.com/virginaustralia/en/home/ the Europcar webpage www.europcar.com.au/newyork or the Virgin Australia co-branded partner website within the Promotional Period.

8. 

If you have been entered into the Promotion but no longer wish to participate, please email social.au@europcar.com  and you will be removed from the Promotion.

9. 

The entrant must be the named main driver on the rental agreement entered into with Europcar.

10. 

Entries must be received by 23:59 (AEST) Sunday 30 June 2019. The time of entry will in each case be the time the entry is received by the Promoter. The Promoter accepts no responsibility for any late, lost or misdirected entries for any reason.

Car rental account use is subject to the Promoter’s standard rental Terms and Conditions available at www.europcar.com.au or www.europcar.co.nz

13. 

The Promoter and the Sponsors reserve the right to request winners provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including rental agreement and flight itinerary) in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the party that has requested the proof of identification, residency and/or entry. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

14. 

The Promoter and Sponsors reserve the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

15. 

Any entry that is made on behalf of an Entrant by a third party will be invalid.

16. 

One (1) Major Prize Winner will receive:

a. Return economy flights for two (2) adults and two (2) children (aged up to 12 years) from the Winner’s nearest Capital City to New York. Redemption booking conditions will be supplied to the Prize Winner.

b. Two (2) nights’ shared accommodation at a min. four star hotel in New York for four (4) people. 1 night’s accommodation NYC either side of arrival and departure. Redemption booking conditions will be supplied to the Prize Winner.

c. Morning or afternoon tea at Boris and Horton New York (via EFT)

d. Return New York City Penn Station to Hudson – train tickets for 4

e. Three (3) nights’ accommodation at Kinderhook Farm Stay for four (4) people. *subject to availability at time of booking.  A similar property will be selected if unavailable.  Kinderhook Farm availability is 23rd May through to 2nd September 2019

f. AUS$300 Meal allowance – farm stay (via EFT)

g. Travel insurance

h. All airport/hotel/train station (New York and Hudson) transfers

17. 

The total Major Prize value is up to $18,000 (including GST).

18. 

There are 25 Minor Prizes to be won. A Minor Prize consists of 1 x Family Pass (up to 4 people) to see Secret Life of Pets 2 the movie (RRP $80.00)  and merch prize pack (RRP $40.00).

19. 

The total Minor Prize value is up to $3,000 (including GST).

20. 

The total prize value is $21,000 (including GST).

21. 

Prizes cannot be transferred and cannot be redeemed for cash.

22. 

All prize values are correct as at Wednesday 27 March 2019 and are reflective of the recommended retail price and are in Australian dollars (AUD). The Promoter takes no responsibility for any variations in the prize values.

23. 

Package is based on 2 Adults and 2 Children under 12 sharing a room.

24. 

Kinderhook Farm date availability is 23rd May through to 2nd September 2019.  If farm unavailable for winners selected travel dates then alternative accommodation arrangements will be made to the same value.

25. 

Dates of travel must be confirmed within 60 days of notification of winning prize.

26. 

All elements are subject to availability at time of booking. There is no cash alternative. Prize is non-refundable and non-transferable.

27. 

Not to be taken over USA or Australian Public or National holiday periods.

28. 

Not valid between 16 December 2019 and 16 January 2020.

29. 

Travel must be completed within 12 months of notification of winning

30. 

Winner will be required to produce credit card upon check in to hotel for incidentals. This is mandatory.

31. 

At least one person (winner) travelling must be 18 years or over. If the winner is under 18 then his/her guest must be his/her parent or guardian.  

32. 

Airline Tickets are non-transferable (i.e. no name changes allowed).  Once tickets are issued, they are non-transferable. Any alterations to confirmed flights and/or accommodation and/or scheduling arrangements will be at the expense of the winner and their travelling companions and cannot be split across different time periods.

33. 

Individual supplier terms and conditions apply.

34. 

Flights are economy class and may be indirect. The airline’s Conditions of Carriage apply to all flights. The Winner and travelling companions must travel at the same time and are responsible for transport from their residence to their nearest Capital City Airport in Australia. These conditions apply for all flights.  

35. 

Airline, flight route and dates of travel are subject to the promoter’s absolute and final decision.

36. 

Winner and his/her guest must have valid e-passports and applicable visas/permissions. Passports must have 6 months validity from the return date of entry back into Australia.

37. 

Winner and his/her guest are responsible for registering with the US Visa Waiver programme:https://esta.cbp.dhs.gov if applicable.

38. 

The United States requires that travellers entering the United States under the Visa Waiver Program (ESTA) hold an e-Passport if their passport was issued on or after 26th October 2006.

39. 

Travel Insurance to the value of $200 per person will be provided as part of the prize package. 

40. 

Travel insurance is valid for passengers under 85 years of age and without pre-existing conditions: PRE-EXISTING CONDITION means: in respect of Injury: a condition with which the Insured Person was aware of (whether diagnosed or not) or has sought treatment prior to the Insured Travel covered under this Policy.  2. in respect of Sickness: i. a condition or side effect with which the Insured Person was aware of (whether diagnosed or not) or has sought treatment prior to the Insured Travel covered under this Policy. If any form of cancer is a Pre-Existing Condition, then there is no cover for cancer or cancer-related conditions.  ii. a condition caused by a Pre-Existing Condition, that is, any medical condition that You have suffered from or been treated for, irrespective of whether a complete recovery has occurred.  In the event of not qualifying for the included travel insurance, the winner will be required to obtain their own travel insurance policy.

41. 

Any changes by the winner made to the specified prize package (including travel extensions, additional guests, etc) will be subject to an administration fee of $250 excluding GST, which must be settled in full prior to booking confirmation.

42. 

Travel on Virgin Australia flights is subject to Virgin Australia’s Conditions of Carriage, which are available at http://www.virginaustralia.com/au/en/about-us/legal-policies/conditions-of-carriage/  and are subject to change. Bookings are subject to the Fare Rules applicable to your fare and are available here: http://www.virginaustralia.com/au/en/plan/fare-types/.

43. 

The Major Prize Winner and travelling companions  are responsible for all other expenses including spending money, meals, drinks, transfers unless specified, laundry charges, activities, incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

44. 

The Major Prize Winner and travelling companions must travel at the same time, must depart from the same Capital City and are responsible for transport from their residence to their nearest Capital City for flight departure.

45. 

Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.

46. 

A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.

47. 

It is the traveler’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travelers.

48. 

Travel must be taken within 12 months of the prize issuance, or at the time specified by the Promoter. If the Major Prize Winner and their travelling companions are, for any reason, unable to travel on a nominated date, or do not take an element of the prize will be forfeited by the Major Prize Winner. Cash will not be awarded in lieu of the prize or element thereof.

49. 

Travel is subject to hotel and flight availability. The prize is not available during peak times such as public holidays and school holidays (if applicable) and cannot be changed once the booking has been made.

50. 

The Promoter, the Sponsors, and Engage Australia Pty Limited, make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.

51. 

Unless expressly stated in these Terms and Conditions, all other expenses become the responsibility of the Winners.

52. 

If the prize is unavailable for any reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.

53. 

Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for the prizes damaged, delayed, or lost in transit.

54. 

Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

55. 

By accepting the prize, the Winners agree to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

56. 

By accepting the prize, the Winners agree to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

57. 

Prize to appear in connection with Europcar Australia or the advertising or marketing thereof, in any media whatsoever throughout the world and the Winner will not be entitled to any fee for such use.

58. 

Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

59. 

Each valid entrant who has entered the competition over the duration of the Promotional Period will be entered into the Major and Minor Prize Draws. One (1) valid entrant will be drawn at random to become the Major Prize Winner. Twenty (20) valid entrants will be drawn at random to become Minor Prize Winners.The draw will take place at Engage Australia Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060, on Thursday 4 July 2019 at 14:00 (AEST). The Major Prize Winner will be notified in writing within two (2) days of the draw and have their name published in the Public Notices section of The Australian on Wednesday 10 July 2019.

60. 

The Minor Prize Winners will receive the family movie pass and merchandise pack within two (2) weeks of the draw.

61. 

If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.

62. 

Prizes will be awarded to the person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (e.g. Rental Agreement Holder).

63. 

Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

64. 

Subject to any direction given under relevant State legislation, an unclaimed prize draw for both Major and Minor prizes will take place at Engage Australia Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060 on Friday 20 September 2019 at 11:00 (AEST). The winners will be notified within by email within two (2) days of the draw. The Unclaimed Major Prize Winner will have their name published in the Public Notices section of The Australian on Friday 27 September 2019.

65. 

The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result.

66. 

It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

67. 

It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

68. 

In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.

69. 

The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

70. 

The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

71. 

The Promoter, the Sponsors, and Engage Australia Pty Limited and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

72. 

If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.

73. 

All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent. 

74. 

The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) and by entering the competition, the Entrant is taken to consent to Europcar Australia’s privacy policy which contains information, among other things, about how the Entrant may access personal information that is held by Europcar Australia about them and seek correction of such information.
